Terms of Service

1. Acceptance of Terms
Welcome to Spatial, developed by Hinokami Studio. By downloading, installing, or using Spatial, you agree to these Terms of Service. If you don't agree, please don't use the app.
2. Description of Service
Spatial is an AI-powered mobile application that allows you to:
- Upload photos of rooms
- Transform photos into 3D isometric designs
- Edit rooms by adding or removing items
- Apply different design styles ("vibes")
- Generate videos of your 3D room designs
The service operates on a credit-based system. You can purchase credits individually or through subscriptions.
3. Account Requirements
Eligibility
- You must be at least 13 years old to use Spatial
- You must provide accurate account information
- You are responsible for maintaining the security of your account
Account Security
- Keep your login credentials confidential
- You are responsible for all activity under your account
- Notify us immediately at sebastian@hinokami.studio if you suspect unauthorized access
4. Credits and Subscriptions
How Credits Work
Here's what the most common operations cost:
- Make 3D: 10 credits
- Image Edit: 10 credits
- Orbit View: 70 credits
Purchasing Credits
- One-Time Purchases: Buy credit bundles as consumables
- Subscriptions: Subscribe for recurring credits (weekly or monthly)
- All purchases are processed through the Apple App Store
- Prices are shown in your local currency in the app
Refunds
- Failed Operations: If an AI generation fails, your credits are automatically refunded
- Purchases: Refund requests for credit purchases must be made through the App Store (we cannot process refunds directly)
- Subscriptions: Managed through your Apple ID subscription settings
Credits Do NOT Expire
- Unused credits remain in your account indefinitely
- Credits are non-transferable between accounts
5. Acceptable Use
You MAY:
- Use Spatial for personal, non-commercial room design projects
- Upload photos you own or have permission to use
- Share your generated designs
You MAY NOT:
- Upload inappropriate, offensive, illegal, or copyrighted content you don't own
- Attempt to hack, reverse-engineer, or abuse the app's systems
- Use the service to generate harmful or illegal content
- Resell or commercialize designs without proper rights
- Create multiple accounts to exploit free credits
- Use automated bots or scripts to interact with the service
Violation of these terms may result in account suspension or termination without refund.
6. Content and Intellectual Property
Your Content
- You retain ownership of the photos you upload
- You grant Hinokami Studio a license to process your photos solely to provide the service (AI generation, storage, display)
- We do not claim ownership of your photos or generated designs
- We do not use your content for marketing without your permission
Generated Designs
- AI-generated designs are created based on your input photos and instructions
- You may use generated designs for personal or commercial purposes
- Hinokami Studio does not guarantee exclusive rights to AI-generated content (AI may produce similar outputs for different users)
Our Intellectual Property
- Spatial's app design, code, branding, and features are owned by Hinokami Studio
- You may not copy, modify, or redistribute the app or its components
7. AI-Generated Content Disclaimer
No Guarantees
- AI generation is experimental and results may vary
- We do not guarantee specific outcomes, accuracy, or quality
- Generated designs may not be architecturally accurate or feasible
Third-Party AI Services
- Spatial uses third-party AI providers (Google Vertex AI, AtlasCloud)
- These services operate independently and have their own terms
- We are not responsible for AI service failures or limitations
If AI generates inappropriate or unexpected content, please report it to sebastian@hinokami.studio. We will investigate and may refund credits if appropriate.
8. Limitations of Liability
To the maximum extent permitted by law, Spatial is provided "AS IS" without warranties of any kind.
We are not liable for:
- Loss of data or projects
- Service interruptions or downtime
- AI generation errors or unexpected results
- Third-party service failures (Firebase, Google, AtlasCloud, RevenueCat)
- Indirect, incidental, or consequential damages
Maximum Liability
Our total liability to you is limited to the amount you paid for Spatial in the past 12 months.
9. Service Availability
- We strive for 24/7 availability but cannot guarantee uninterrupted service
- We may perform maintenance, updates, or changes without notice
- We reserve the right to modify or discontinue features at any time
- No refunds for temporary service disruptions
10. Account Termination
By You
- You may delete your account at any time from Settings
- Deletion is immediate and permanent (all projects, images, and data are erased)
- Active subscriptions must be cancelled separately through the App Store
By Us
We may suspend or terminate your account if:
- You violate these Terms of Service
- You engage in fraudulent or abusive behavior
- Required by law or to protect other users
- Your account is inactive and poses a security risk
Termination does not entitle you to refunds for unused credits or active subscriptions.
11. Changes to Terms
We may update these Terms from time to time. When we do:
- We'll update the "Last Updated" date
- We'll notify you via email if changes are material
- Continued use after changes means you accept the new terms
12. App Store Terms
Spatial is distributed through the Apple App Store. You also agree to:
- Apple's App Store Terms of Service
- Apple's Licensed Application End User License Agreement (EULA)
In case of conflict between these Terms and Apple's terms, Apple's terms prevail for App Store-related matters (purchases, refunds, distribution).

14. Third-Party Services Notice
Spatial integrates with:
- Firebase/Google Cloud (infrastructure)
- Google Vertex AI (AI image generation)
- AtlasCloud (AI video generation)
- RevenueCat (subscription management)
- Apple Sign-In / Google Sign-In (authentication)
Use of these services is subject to their respective terms and policies. We are not responsible for their actions or failures.
By using Spatial, you acknowledge that you have read, understood, and agree to these Terms of Service.
